Lemba Terms of Service

These terms are the agreement between you and [operator name to be confirmed] ("Lemba", "we") for using the Lemba app and the Lemba website. By creating an account or using Lemba, you agree to them. Please read them with the Privacy Policy, which explains how Lemba handles your data.

Who can use Lemba

Lemba is made for students at universities and other tertiary institutions. You can use it if you are 18 or older, or if you are under 18 and a parent or guardian has agreed. Lemba is not meant for children.

Your account

• Give accurate sign-in details and keep your password and devices secure. What happens in your account is your responsibility unless someone got in without your permission because of something we did wrong.
• Tell us at support@lemba.one if you think someone else is using your account.
• One account is for one person. Don't share it or sell it.
• You can stop using Lemba at any time, and you can delete your account in the app. See Delete your account and data.

What Lemba is, and is not

Lemba helps you organise your studies: your timetable, work, attendance, grades, plans and reminders, and a class you share with classmates.

• Lemba is independent. It is not run by, endorsed by or connected with your university or any other institution, unless we say so clearly for a particular institution.
• Lemba is not an official record. Your institution's timetables, notices, results and rules are what count. If Lemba and your institution disagree, your institution is right. Check anything important (exam times and venues, deadlines, grades, graduation requirements) with the official source.
• Class reps on Lemba are students named by their class on Lemba. Lemba does not check that they are the class rep your institution recognises.

Lemba's answers and AI

Lemba answers many questions from your own data on your phone. With Lemba Pro and your agreement, it also uses an AI provider, Anthropic, to understand what you ask, read photos and documents, and help you study.

• Lemba checks changes against your data and asks you before anything important, but it can still misunderstand you or misread a document. Review what it adds or changes.
• Study help can be wrong or incomplete. It is there to help you learn, not to replace your lecturers, your course materials or your own judgement.
• You are responsible for following your institution's rules on academic honesty when you use Lemba. Don't use it to cheat.

If an answer looks wrong, offensive or unsafe, press and hold it and choose Report, so we can fix it.

Your content

Your content is what you put into Lemba: your courses, timetable, work, notes, plans, messages to Lemba, photos, documents, announcements and anything else you add.

• You own your content. Lemba does not claim it.
• You let us use it to run Lemba for you. You give us permission to store, copy, process and show your content only as needed to provide Lemba to you and to the people you choose to share it with, as described in the Privacy Policy. This includes sending it to our service providers, and to our AI provider when you allow it.
• What you share with a class stays with the class. When you share your timetable with your class, post an announcement or share work, you let us show it to the class's members, now and in the future, and keep it for them after you leave. If you delete your account, your announcements are taken down, and the rest stays for the class without your name. The same applies to a grading system you choose to share with students at your institution.
• You must have the right to share it. Only upload content that you are allowed to share, and don't upload other people's personal information without a good reason.

If you send us ideas or feedback, we can use them to improve Lemba without owing you anything.

Classes

A class on Lemba is a group of students, created by students. Everyone in a class agrees to these rules:

• Share academic information that you believe is accurate. Don't post fake class changes, fake deadlines or fake exam details.
• Treat classmates with respect. No harassment, threats, hate, sexual content, or content that is violent or degrading.
• Don't post other people's personal information, such as phone numbers, addresses, photos or grades, without their permission.
• No spam, advertising, scams, or links to harmful sites.
• Don't pretend to be someone else, including your institution, a lecturer or the class rep.

Running a class. Classes have an owner and may have admins, moderators and class reps, each with the abilities Lemba shows them. Moderators can take down announcements, and remove or restrict members who break these rules. A class's owner can hand the class to someone else. If an owner is inactive or a class disputes its owner, members can vote, and some decisions go to Lemba's reviewers. We try to be fair, and we may ask for information before deciding. What we decide about who runs a class applies inside Lemba; it does not affect any other right you have.

Reporting. You can report an announcement to the class's moderators and to Lemba, and you can hide announcements from a person on your phone. We look at reports we receive and may remove content or restrict accounts that break these terms, even if a class's moderators did not.

Using Lemba properly

Don't:

• break the law, or use Lemba to harm, harass or deceive anyone;
• try to get into another person's account or data, or into parts of Lemba you are not allowed to use;
• copy, scrape, overload, disrupt or attack Lemba or the services it runs on;
• reverse engineer the app, except where the law allows it;
• use automated means to create accounts, send requests or post content;
• use Lemba to build a competing service, or resell it without our written permission;
• try to make Lemba's AI produce harmful content or ignore its safeguards.

Lemba Pro

What it is. Lemba Pro is a pass. It adds Lemba understanding anything you say or type and doing it for you, reading photos and documents, and Study. Everything else in Lemba stays free. What Pro includes is listed before you pay. Pro belongs to your Lemba account, so it works wherever you sign in to Lemba.

Price and length. The price and the length of the pass are shown before you pay, in Ghana cedis, and that is the full amount you pay Lemba. Your mobile money provider may charge its own fees. A price change never affects a pass you have already bought.

Paying. You pay with mobile money on the payment page of Kora (Korapay), our payment provider. Lemba never sees your mobile money number or PIN. Kora's own terms apply to the payment.

When it starts. Pro starts as soon as your payment is confirmed, normally within a few minutes. If your pass is still running when you buy another, the new one starts when the current one ends, so you never lose paid time.

No automatic renewal. A pass does not renew by itself and you are never charged again automatically. When it ends, Pro features stop until you buy another pass. Nothing you created is deleted.

Keeping a record. Your Pro dates are in Settings. We keep a record of each payment (see the Privacy Policy) and will send you a copy of it if you ask.

Cancellations and refunds

Pro starts straight away. Before you pay, the Pro screen tells you that Pro starts as soon as your payment is confirmed. By paying, you ask for it to start straight away. Under Ghana's Electronic Transactions Act, 2008, the seven-day period for cancelling a service without a reason does not apply to a service that began with your consent within that period, so a pass cannot be cancelled for a refund just because you changed your mind once Pro has started.

When we refund. We refund you:

• if you paid but Pro did not start and we cannot fix it;
• if you were charged twice for the same purchase;
• if a payment was made from your mobile money without your permission;
• if a payment is confirmed after you deleted your account;
• if we stop offering Lemba Pro before your pass ends, for the days you have not used;
• in any other case where the law gives you a right to a refund.

How. Contact support@lemba.one with the payment reference, which Lemba shows you and Kora sends with your payment. If Pro could not be provided, we refund within 7 days of telling you so. Any other refund we agree to is made within 30 days. Refunds go back through Kora to the way you paid.

Nothing in these terms takes away your rights as a consumer under Ghanaian law.

Suspending or ending your use

We may suspend or close an account, or remove content, if you seriously or repeatedly break these terms, if the law requires it, or to protect other students or Lemba. Unless the law or safety prevents it, we will tell you why and give you a way to respond. If we close your account because you broke these terms, we do not refund a pass that has already started, unless the law requires it.

If we decide to stop offering Lemba altogether, we will tell you at least 30 days before, and give you a way to keep a copy of your data.

Lemba's rights

The Lemba app, name, logo and design belong to [operator name to be confirmed]. We give you a personal, non-transferable permission to use the app for your own studies, on devices you own or control, under these terms. You may not copy, sell or modify the app, or use our name or logo, without our written permission.

Availability and changes to Lemba

We work to keep Lemba running and your data safe, but we cannot promise that it will always be available or free of errors. We may change, add or remove features. If a change takes away something important you paid for, we will tell you before it happens and, if it affects a pass you already bought, offer a refund for the days affected.

Liability

Lemba is a tool to help you organise your studies. To the extent the law allows:

• we are not responsible for losses caused by relying on Lemba instead of your institution's official information, such as a missed class, deadline or exam;
• we are not responsible for losses we could not reasonably have foreseen, or for events outside our reasonable control;
• our total responsibility to you for all claims is limited to the amount you paid Lemba in the 12 months before the claim.

Nothing in these terms limits any responsibility that Ghanaian law does not allow us to limit, including your rights under the Electronic Transactions Act, 2008 and the Data Protection Act, 2012.

If you got Lemba from Apple's App Store

• These terms are between you and [operator name to be confirmed], not Apple. Apple is not responsible for Lemba or its content.
• Your permission to use the app is limited to Apple devices that you own or control, as the App Store's usage rules allow.
• Apple has no obligation to provide any maintenance or support for Lemba.
• If the app does not conform to any warranty that applies, you may tell Apple, and Apple will refund the price you paid Apple for the app, if any. Apple has no other warranty obligation for the app.
• Apple is not responsible for dealing with any claim by you or anyone else about the app, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and consumer protection or privacy claims.
• If anyone claims that the app or your use of it infringes their intellectual property, [operator name to be confirmed], not Apple, is responsible for dealing with that claim.
• You confirm that you are not in a country subject to a United States government embargo, or listed by the United States government as a prohibited or restricted party.
• Apple and its subsidiaries can enforce these terms against you as third-party beneficiaries.

Law and disputes

These terms are governed by the laws of Ghana. If you have a problem, please contact us first at support@lemba.one and we will try to resolve it. If we cannot, the courts of Ghana can decide it. This does not stop you from using any other remedy the law gives you, including complaining to Ghana's Data Protection Commission about your personal data.

Changes to these terms

We may update these terms, for example when Lemba changes or the law does. The version and date at the top will change. If a change matters to you, we will tell you in the app before it takes effect. If you do not agree with a change, you can stop using Lemba and delete your account; if it affects a pass you bought, you can ask for a refund of the days you have not used.

Lemba is not a member of a self-regulatory body and has not signed an industry code of conduct or an alternative dispute resolution scheme.
